Scary: Halloween DUI patrols increase odds of arrest

Werewolves, witches, wrestlers, waiters and wildlife will all be roaming Bryan County streets in just a few days. Halloween is right around the corner and with it comes trick-or-treating for the little ones and costume parties and clubs for those a bit older.

Also part of the annual observance of Halloween are increased drunk driving patrols in Richmond Hill and all across Georgia. The point of those patrols is more than public safety, of course. It is also to stop vehicles and make DUI arrests.

As regular readers of our blog know, the penalties for a conviction in Georgia for driving under the influence are harsh. A first DUI offense can result in the following punishments:

  • A minimum of 24 hours in jail up to 12 months behind bars
  • A year of probation
  • Fines (typically around $1,000)
  • Community service
  • Driver's license suspension
  • Alcohol and drug counseling
  • DUI school
  • Mandatory installation of an ignition interlock device (at your expense)

Indirect costs of a DUI conviction can also be painful, including sharply increased auto insurance costs, loss of a job or academic opportunities, as well as a tarnished reputation among friends, family and colleagues.

One way to avoid a DUI is to designate a sober driver for all your Halloween adventures. Another way is to contact AAA. The driving service club is once again offering its free "Tow to Go" program in Georgia.

All you have to is call the service. Whether you are a AAA member or not, a tow truck will be dispatched to pick you and your vehicle up and take you to another location (within 10 miles). No call for a taxi, Uber, friend or family member needed.

Those who face the harsh sanctions of DUI law can also take steps to protect their rights, freedom, driving privileges and wallet. The first step is to decline to discuss matters with police or prosecutors until after you have talked over your legal options with an attorney experienced in DUI defense.
